RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT
THIS IS A LEGALLY BINDING DOCUMENT. PLEASE READ CAREFULLY.
This Release and Waiver of Liability (the “Agreement”) is executed on this ___ day of __________, 20, by the undersigned participant or parent/legal guardian (if participant is under 18), in favor of Next Sports Enterprises, LLC, its owners, officers, agents, employees, volunteers, affiliates, sponsors, successors, assigns, subsidiaries, and any other parties operating at or on behalf of the soccer park known as Next Soccer Park, located at 1555 Simi Valley Town Center Way, Simi Valley, Ca 93065 (the “Facility”).
1. ACKNOWLEDGMENT OF RISKS
I understand and acknowledge that participation in soccer, fitness, and recreational activities offered by Next Sports Enterprises involves inherent risks, including but not limited to:

Sprains, fractures, concussions, dehydration, heatstroke, and other physical injuries

Collisions with other participants, balls, field equipment, or surfaces

Environmental risks such as heat, rain, wind, and uneven or slippery turf

Improper or negligent use of fields, nets, goals, balls, or other training equipment

Exposure to communicable diseases, including but not limited to COVID-19 and MRSA
-
Accidental or negligent acts of other players, coaches, or spectators
I understand these risks and fully assume all risks, known and unknown, even if they arise from the negligence of the released parties named below.
2. RELEASE OF LIABILITY
I, the undersigned, on behalf of myself, my child (if applicable), my heirs, executors, administrators, assigns, and personal representatives, hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Next Sports Enterprises, LLC, its directors, employees, volunteers, and affiliates (collectively, the “Released Parties”) from any and all claims, actions, causes of action, suits, losses, liabilities, or damages for injury, illness, death, or property damage arising out of or in connection with my (or my child’s) use of the Facility, participation in any league, class, camp, event, or other soccer or athletic activity, whether caused by negligence, breach of contract, or otherwise.
3. INDEMNIFICATION
I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all liabilities, claims, demands, causes of action, damages, costs, or expenses (including reasonable attorney’s fees) arising out of or related to my or my child’s participation in activities or use of the Facility.
4. MEDICAL AUTHORIZATION & INSURANCE
I certify that I am physically fit and have no medical conditions or physical limitations that would prevent safe participation. I consent to emergency medical care and transportation if needed. I understand that Next Sports Enterprises does not carry medical or accident insurance for participants and that I am financially responsible for any and all medical treatment. I agree that I am responsible for obtaining and maintaining health insurance coverage for myself and/or my child.
5. BEHAVIOR & FACILITY RULES
I agree to follow all posted and communicated rules, regulations, and instructions from staff and coaches. I understand that inappropriate behavior, abusive language, harassment, or any activity that endangers others may result in removal from the Facility without refund. I will be respectful to other players, coaches, spectators, and staff. Any damage caused by myself or my child to Facility property will be my financial responsibility.
6. INCLEMENT WEATHER & CANCELLATIONS
I acknowledge that outdoor activities are subject to weather and environmental conditions. Next Sports Enterprises reserves the right to cancel, postpone, or modify any program due to safety concerns, inclement weather, or other unforeseen circumstances. I understand that refunds are not guaranteed in such situations unless specified otherwise.
7. MEDIA RELEASE
I grant full permission to Next Sports Enterprises to take and use photographs, videos, and other media recordings of myself and/or my child for promotional, marketing, social media, and other lawful purposes without compensation or notification.
8. MINOR PARTICIPANTS
If I am signing on behalf of a minor participant, I certify that I am the parent or legal guardian of the participant named below and have the authority to sign this Agreement on their behalf. I agree to be bound by the terms of this Release and to indemnify the Released Parties for any claims brought by or on behalf of the minor.
9. SEVERABILITY & GOVERNING LAW
This Agreement shall be governed by the laws of the State of California. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
10. ACKNOWLEDGMENT AND UNDERSTANDING
I HAVE READ THIS ENTIRE AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT VOLUNTARILY WITHOUT INDUCEMENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN MYSELF AND NEXT SPORTS ENTERPRISES, LLC.
